Firefighter hopefuls claim FDNY barring them for past convictions
Two black firefighter wannabes who gained an edge trying to join the department through a discrimination lawsuit are now suing again because they say they are still being barred — over their criminal records.
The two candidates filed separate suits in Manhattan Supreme Court on Monday contesting the FDNY’s decision to bar them because of their convictions.
Hazim Tawfiq, 42, of Harlem was arrested four times between 1992 and 2005 for misdemeanors including criminal possession of a gun and marijuana possession. He pleaded out in each case.
Tawfiq says his last run-in with the law was 10 years ago and he has since become a Boy Scout volunteer and has his own silk-screening business.
The second aspiring firefighter, Alphonso Wright, 36, of Queens also has no felonies, but was nabbed for shoplifting from a Home Depot in 2004 and for allowing a friend to use his car to transport 60 grams of cocaine in 2006. He, too, pleaded out.
Today, Wright is a married husband holding down “multiple jobs,” according to his suit.
The Fire Department does not automatically disqualify candidates who have been arrested or convicted of a crime, and an applicant’s rehabilitation and good conduct should be considered, according to FDNY guidelines.
Both men were ultimately rejected based on their “character” and criminal history, according to FDNY records.
A spokeswoman for the city’s Law Department said, “We will review the complaint upon service.”
Tawfiq and Wright were among 1,500 plaintiffs in a federal class-action suit over the FDNY’s entrance exams, which were found to be biased. The suit was settled last year.
