FDNY Commissioner Daniel Nigro now confirms the lack of information available to Lt. James Hayes and the crew from Engine 158 Friday morning before Lt. Hayes was wounded. In addition, local political leaders say they want answers about the communications between FDNY and law enforcement.
When asked about the report, an FDNY spokesman referred to FDNY Commissioner Daniel Nigro’s statement from Friday: “Well, certainly at the time the fire officer was not aware of the person’s history. There was no evidence that he was armed. There was evidence that there was a heavy smoke condition – an unknown number of occupants in the apartment. So, Lieutenant Hayes made a decision to search the apartment.”

There is controversy over the shooting of FDNY’s Lieutenant James Hayes at a Staten Island home on Friday (radio traffic from incident is here). Hayes is out of the hospital recovering from being shot in the hip and ankle by Garland Tyree, a Bloods gang leader. Federal law enforcement officials and NYPD had gone to the home to serve a warrant when the confrontation occurred. Tyree was later shot and killed by police.
The dispute, according to the New York Post, is over what Lt. Hayes and his firefighters did or didn’t know before entering the home.
“[Hayes] absolutely didn’t know he was heading into a situation that dangerous,” one firefighter told The Post on Sunday. “We’re the Bravest, not the Stupidest.”“They didn’t tell us about anyone in the house or what was going on,’’ a second firefighter said. “They allowed us to walk in there without telling us what was going on.”But law-enforcement sources said Hayes and his men were definitely given a summary of the situation and told that Tyree might be armed. Hayes was warned not to enter the home with Tyree still inside, they said.
